Consent as a Basis for Processing
In some cases, we will ask for your consent to access your Contacts. Contact details will be uploaded and stored on the server for the purpose of sending SMS invites and challenge request notifications when the server has verified which contacts either have downloaded the app or those who have not yet installed the app. You may indicate your consent in a number of ways, including, as permitted by law, clicking ‘Okay’ button (or equivalent action) to indicate your consent when (i) providing us with your Personal Data through our Services (ii) registering or creating an account with us. We may request your consent to access your Contacts. This allows you to seamlessly invite people to download the app. Contact details will be uploaded and stored on the server for the purpose of sending an SMS invite and then to verify the contact when the invite is accepted.
We also may request your consent to access your Contacts so that those individuals who have also downloaded the Matchup Math app can be sent a challenge request notification when you wish to play a game in multiplayer mode.
OUR POLICY REGARDING CHILDREN
Generally speaking, our mobile application and website are not intended for children under the age of 13 (and those under the age of 16 years old who reside in the UK or European Countries) (collectively, “Children”). Children are not permitted to use our Services, and we do not knowingly collect, store or use any personal information from Children.
Though our Services do not target Children as the primary user, we do collect age information during the sign up process to establish a baseline for the starting level of difficulty for the Matchup Math game. In the event that a user identifies himself or herself as a child under the age of 13 during the sign up process via our age-gate, we will terminate the effort to create an account.
If we learn that we have inadvertently gathered personal information from a Child, we will take reasonable measures to promptly remove that information from our records.

Your Opt-Out Rights
Opt-out of all information collection by uninstalling the Application: You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Matchup Math uses Amazon AWS to host its mobile application. AWS provides on-demand access to scalable web and application servers, storage, databases, content delivery, cache, search, and other application services.

Sharing Your Personal Information

Matchup may also retain information after you delete your account if required by law; such information is needed for investigation purposes or for archival purposes.
How We Secure Personal Information
We use a variety of security technologies and procedures to secure Personal Information. When you provide Personal Information we do our best to ensure it’s encrypted via SSL. However, none of these are fail-proof, and we ask for your cooperation in ensuring your information stays safe. Please note we may discard any information: (i) after your account has been cancelled or terminated, (ii) upon your request; or (iii) any time in our sole discretion, whichever occurs earlier.
Data Retention Policy, Managing Your Information
We will retain User provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at firstname.lastname@example.org and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.
Complaint or Inquiry
Internet Security and Possible Risks
Matchup cannot warrant the security of data while in transit to or from our App. By using a Service, you will be deemed to have assumed such risks.
Geographic Restrictions, Applicable Law
The App may only be accessed within the USA and Canada. Any claim relating to the App shall be governed by the internal laws of the State of California without reference to its choice of law provisions, and shall be resolved solely through proceedings held within the State of California.
Privacy Rights for California, North Dakota and Vermont Residents
California. A California resident may request us not to share Personal Information with a third party. Existing California users can provide us with their order ID, name, and email address and postal address either by email at email@example.com. In case of any email inquiry, users will receive a computer generated reply confirming our receipt. In accordance with California Civil Code Sec. 1789.3, California resident users are entitled to know that they may file grievances and complaints with California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112 or by phone at 800-952-5210.
North Dakota. Pursuant to state law, we will only share information with our service providers and with third parties as required or permitted by law or as permitted by you.
